Terms of business

The basis on which we act as broker, and the limits of what we undertake.

Scope

These terms describe how we act as broker and where the limits of that role lie. They apply alongside, not instead of, the terms of the individual offer you accept.

Commercial terms, including rates and cancellation, are agreed individually in each offer and are not published here.

The relationship

What we undertake.

We act as a broker We source, assess and arrange aircraft charter. We do not operate aircraft and we hold no air operator certificate.
The carriage contract is not with us It is concluded between the client and the operating air carrier, on that carrier’s conditions of carriage and the applicable conventions.
We verify before we offer Operator certificate and scope, insurance and sums insured, crew experience and duty time feasibility, and the maintenance status of the specific aircraft offered.
We disclose what we find An operator that fails a check is not offered, and we say that it happened.
Offers and bookings

How a flight is agreed.

An enquiry binds nobodyNothing is committed until a named offer is accepted in writing.
An offer names the specificsThe operator, the aircraft registration, the route with timings, what is included, and what remains variable.
Availability is subject to confirmationUntil the operator confirms, an aircraft quoted may be taken by another client.
Permits and duty limits governA flight is subject to overflight and landing permits, slots and crew duty limits. Where one of these fails, we say so and propose alternatives.

Liability

As broker we are liable for the care we exercise in selecting and arranging the operator. We are not liable as a carrier for the performance of the flight itself, which is governed by the contract between the client and the operating carrier and by the applicable conventions.

Delay, diversion and cancellation by the operator are dealt with under that carriage contract and the conventions that apply to it. Where one happens we act on your behalf with the operator, and we say at the time what the carrier owes and what it does not.

Governing law and jurisdiction

Swiss law applies, with the courts at our place of business in Wolfhalden having jurisdiction, subject to any mandatory consumer protection rules that apply to a particular client. A client domiciled in the European Union keeps whatever protection its own law gives it that cannot be contracted away.
